I/We (“Applicant(s)”) have been informed that a proposed plotted development, containing non-agricultural plots, at Anjarle and Padale villages of (Taluka) Dapoli (“Plots”) are being developed and marketed by The House of Abhinandan Lodha® vide Sharpskill Infra Developers Private Limited (“you”) under the name “Codename- Tomorrow Land” and you have invited applications for the same (“Project”).
I am/we are interested in applying in the Project (as per the inventory requirement submitted in this application)
You have informed me that:
It is understood that you shall not be carrying out any construction on the Plots. I am entitled to construct at my risk and cost upon the Plot allotted to me, in accordance with the applicable construction approvals and regulations; as well as the bye laws of the association of Plot purchasers in the Project.
The application fee is defined in Annexure B. Please consider this application form along with the application fee as a formal complete application from my/our end.
I/We understand that you have obtained NA for part portion of the development and are in the process of obtaining the remaining/revised NA layout orders (Order) and expect to do so on or in accordance with the project timelines, subject to any force majeure circumstances or circumstances beyond control.
I/We understand that you reserve the right to accept or reject the Application Form at your sole discretion and without assigning any reason for the same. Upon your acceptance of my application, you shall intimate to me and forward to me a copy of the Order (when obtained) and the details of the Plot allotted to me. The application fee shall then be adjusted against the total consideration payable for (a) sale of the Plot(s); and/ or (b) Development Services.
I/We understand that we shall be allocated a Plot within 90 days from the date of application subject to receipt of the Order. Post confirmation of plot allocation, the payments and registration timelines will be followed by me in adherence to the payment plan mentioned in Annexure B.
I/We agree with the payment timelines highlighted in Annexure B. Time as to payment is of the essence and all overdue payments will bear interest at SBI MCLR+2% per annum.
In the event I/we fail to pay the amounts due per the applicable payment schedule, you shall have the right to cancel my/our application and the consequences of cancellation as set out in these terms and conditions shall ensue.
I/We understand that the definitive agreements/documents will be registered with the office of the relevant Sub-Registrar of Assurances and a 7/12 extract for the Plot will be obtained in my/our name within 60 days from the date of registration of the Deed of Conveyance. A title certificate issued by reputed legal counsels certifying your title to be clear and marketable, shall be conclusive and binding.
The eligibility for withdrawal and corresponding refund timelines are mentioned in Annexure C. I/we have understood and agree to abide by the same.
This Application and the terms hereof shall supersede all the prior discussions and correspondences (written or otherwise) between us, the Applicant(s) and you.
This application is personal to me/us and is not, directly or indirectly, transferable by me/us to any other person/entity. I/we confirm that this letter does not create any right title or interest in my/our favour in respect of any Plot and or in the Project.
The other terms and conditions of this application are set out in Annexure C which I/we have read and understood. The same are acceptable to me along with the terms and conditions of the application forms and I agree to be bound by the same.
I/We declare and affirm that joint allotment failure to pay by anyone of joint applicants shall be deemed as failure to pay by both/all and the joint applicants shall be treated as a single person for the purpose of this Application and both (all) shall be liable for the consequences jointly as well as severally.

Note: The locations of the amenities may change in accordance with site conditions or/and statutory approvals and these are the common amenities across all plots including plots forming part of future expansion and development.

Note:
An Applicant applying should state Inventory type and the count of Plots applied for. Any Application form not stating both inventory type and number of Plots is liable to be rejected as incomplete.
The Applicant shall be liable to pay on demand, amounts towards all government levies/taxes of any nature whatsoever in relation to the Plot(s), including but not limited to, Stamp Duty and Registration charges. Any other government levies/ taxes will be due as applicable when charged.

Annexure C
Withdrawal and Refund policy
Withdrawal Process before registration of the agreement or allotment
Refund in case of withdrawal
All refunds shall be made by NEFT/RTGS which will be deposited into the Applicant designated bank account within 30 working days from the date of the receipt of the withdrawal email or cancelled cheque (whichever is later).
Statutory/government taxes, levies and costs and bank charges (if any), if any shall not be refundable
Withdrawal post allocation
The allocation communication will be made through email.
Incomplete application
An incomplete application is liable to be rejected at our sole discretion.
Few illustrations of incomplete application which may lead to rejection are as follows:
Loan from financial institutions
Loan from the financial institution may be availed by the Applicant basis eligibility and institution norms. However, if a particular institution/bank refuses to extend financial assistance on any ground, the Applicant shall not make such refusal an excuse for non-payment of further instalments/dues and the consequences of non-payment as set out herein shall be applicable to any non-payment for reasons of Applicant being not able to avail loan from an institution/bank.
